The total amount our unethical attorney – J Arthur Smith III has the audacity to claim we owe him for his role in helping to make sure our lawsuit against Riverstone Residential & the owners of Jefferson Lakes Apartments did not make it into court

Eleven thousand – something hundred dollars and something cents!!!  I tossed the bill aside and will have to find it to get the exact amount.

The records sent by Guarantee Services – the company Riverstone Residential usually used to clean out as much mold as possible in the air ducts and dryer vents at Jefferson Lakes Apartments

I say usually because I have photos of at least one other company they used.

The records they sent are not what were subpoenaed because the records that were subpoenaed would have evidence of duct cleaning in the apartment we were leased.  Usually that is the reason the attorney would want those records but not in this case.  There was also no subpoena for records of say any other companies that clean air ducts and dyer vents.  

The records for 2005 and the three previous years were subpoenaed but here we have a miscellaneous collection (2004 – 2007) on a quick report with a selected few more detailed invoices (which have no particular importance over any of the others) thrown in.  This random selection of records (even though it does show an obsessive amount of air duct and dryer vent cleaning) was thrown together for the judge, who wasn’t really going do more than take a quick glance (if that) then grant the motion for summary judgement for the defendant as was the desire of all parties including the plaintiffs attorney!  See attorney malpractice and court documents.

The amount charged for air duct cleaning is usually $215.00 and dryer vent cleaning is usually $150.00.

HUD director is charged with misusing public money – Kansas City

A director for the U.S. Department of Housing and Urban Development in Kansas City, Kan., has been brought up on federal charges of misusing public money.

Federal prosecutors said Thursday that they have charged Herman Ransom, 52, of Olathe, with receiving pay for hours he did not work.

Ransom is under indictment for 10 counts of wire fraud and 10 counts of theft of public money.

Ransom still holds his position with HUD but is on administrative leave, according to a spokesman in HUD’s Washington office.

The indictment said Ransom claimed to have worked 80 hours during two-week pay period reports, though those periods included personal time off.

Also, prosecutors accuse Ransom of playing tennis and going to casinos while he claimed to have been working.

Altogether, federal prosecutors think Ransom has received $47,000 in unmerited pay since starting as a director in 1998 as the HUD office in Kansas City, Kan., where he supervised 89 employees.

A conviction could mean 20 years in prison and $250,000 in fines for each wire fraud count, as well as 10 years in prison and $250,000 in fines for each count of theft of public money.

EL PASO, Texas – Sick children in Ft. Bliss housing: that’s what one soldier’s wife claims and now she says her child will never be the same because of the home they lived in on post.

In September, 2006, the Wesley family moved into their home in the Van Horne neighborhood at Ft. Bliss. For the next two years, 3-year-old Calina went from perfectly healthy to a hospital regular.

“She has up to 120 seizures a day. Now mind you they last between three to five seconds and we don’t always see them, but some of them last longer,” said Calina’s mother, Melissa Wesley.

The seizures combined with dozens of other health problems, such as trouble breathing, cut off oxygen to little Calina’s brain.

“She is now stuck at about 2 and a 1/2, 3 year old age mentally. And she’s getting ready to turn 6,” Wesley exclusively told KFOX.

Wesley blames it all on her home at Ft. Bliss. During her time there, she found black mold growing, lead paint chipping, and a long list of other problems.

“It wasn’t just my child, it was my next door neighbors, it was the lady down the street, it was the parent around the corner, everyone was having issues with their kids being sick,” she said.

As KFOX was the only station to report, between Aug. 12 and Aug. 14, 2008, KFOX did a series of stories about problems with the homes in the Van Horne neighborhood and their impact on the health of soldiers’ families.

“I want nothing more than my daughter to be healed and to have a normal life, but I don’t want someone else to have to go through what we’re going through either,” said Wesley.

Other members of Wesley’s family also had health problems during their time living in the home. Wesley is certain her old home is to blame, because neighbors she spoke to went through the same thing, children perfectly healthy before moving in and leaving with a series of health problems.

KFOX contacted both Ft. Bliss and the private company that owns the homes in the Van Horne neighborhood, Balfour Beatty.

Ft. Bliss officials never returned any of our calls, and Balfour Beatty representatives did get back to us, but did not give us a comment by deadline.
