I, Kevin Carstens, hereby declare as follows:
I am the owner and moderator of a twenty-eight hundred member online support group for those injured by biological contaminants found in water damaged buildings (WDB), “Sickbuildings”. The web address is: http://health.groups.yahoo.com/group/sickbuildings/ I reside in Cornelia, Georgia and have personal knowledge of the facts set forth herein. If sworn as a witness I could and would testify competently thereto….
Many of our members have difficulty obtaining medical treatment for their injuries because of a marketing campaign by the US Chamber of Commerce that began in 2003 and in which it was mass promoted to US physicians, insurers and the courts that it had been scientifically proven all claims of illness and death from “toxic mold” were only being made because of “trial lawyers, media and Junk Science”…..
I am aware and have the evidence posted on Sickbuildings that the plaintiff in this case, Bruce J. Kelman, along with his business partner in the corporation of Veritox, Inc., Bryan Hardin, are the authors of those words that were mass marketed by the US Chamber of Commerce to US physicians, insurers and to courts. I am aware that Veritox was formerly known as GlobalTox, Inc….
I am aware and have the evidence posted on Sickbuildings that the defendant in this case, Sharon Kramer, was the first to publicly write in March of 2005, how the US Chamber of Commerce, Bruce J. Kelman, his company, Veritox, the Manhattan Institute think-tank, US Congressman Gary Miller and the occupational medical trade association, the American College of Occupational and Environmental Medicine (ACOEM) were connected in mass marketing the false concept that it had been scientifically proven people claiming injury from WDB were only doing so because of “trial lawyers, media and Junk Science”……
I am aware and have the evidence posted on Sickbuilding that Bruce Kelman and Veritox sued Sharon Kramer in May of 2005 for five words within the first public writing of how it became a false concept in US public health policy and in US courts that it was scientifically proven all claims of illness from WDB were only being made because of “trial lawyers, media and Junk Science”. Those five words are “altered his under oath statements.”…..
I am aware and have the direct evidence posted on Sickbuildings that the Fourth District Division One Appellate Court issued a second opinion in September of 2010 in which they concealed they had crafted their 2006 anti-SLAPP opinion to make the false finding that Sharon Kramer was guilty of libel with actual malice…..
I am aware that if the court would acknowledge Sharon Kramer’s uncontroverted evidence in its case file that the prior courts framed her for libel, suppressed the evidence that Bruce Kelman (author of mold policy for ACOEM and the US Chamber) committed perjury to establish reason for malice, falsified court documents and then in a second case gagged her from being able to write of what they had done; the deceptive marketing campaign of the US Chamber of Commerce that all claims of illness from WDB are only being made because of “trial lawyers, media and Junk Science” would immediately vanish from policy and courtrooms throughout the United States……
!!!!!If Bruce. Kelman would like to post the direct evidence corroborating the statements he made under penalty of perjury in declarations of why Sharon Kramer would have reason to harbor malice for him, I will share the post with the 2800 members of Sickbuildings!!!!!!……
I am aware the sole cause of action words of the prior case and the purported reason Sharon Kramer is gagged from writing the sole cause of action words “altered his under oath statements” in this case, is because they were allegedly legally found to be a maliciously false accusation that Bruce Kelman committed perjury on the witness stand in Oregon.
If any judiciary involved in this matter, Mr. Kelman or Mr. Scheuer would like to post on Sickbuildings what Sharon Kramer falsely and maliciously accused Bruce Kelman of lying about by her use of that phrase, I will share the post with our 2800 members who have had a difficult time receiving medical treatment because of misinformation mass marketed over the mold issue. To date, I am not aware anyone has been able to state how Sharon Kramer’s phrase “altered his under oath statements” translates into maliciously false accusation of perjury – the sole cause of action words of the entire seven years worth of litigation and supposed sole words for Sharon Kramer’s impending incarceration…..
If the Fourth District Division One Appellate justices would like to post an explanation to the 2800 members of Sickbuildings of why they crafted their Appellate opinions in 2006 and 2010 to make the false finding of libel with actual malice and suppressed the evidence that Bruce Kelman committed perjury to establish needed reason for malice, while knowing they were aiding the marketing campaign of the US Chamber of Commerce to remain in US policy and US courts, I will share the post with the 2800 members of Sickbuildings……
If the clerks of the court would like to post an explanation to the 2800 members of Sickbuildings of why they falsified court documents and computer entries of judgments never entered and concealed who were the true parties to the litigation of Kelman & GlobalTox v. Kramer, I will share the post with our 2800 members……
If Mr. Kelman’s attorney, Keith Scheuer, or the clerks of the court or judiciary would like to post an explanation of how and why Sharon Kramer has an interest accruing lien on her property for costs incurred by Mr. Scheuer’s trial losing client, Veritox, with interest accruing from a date of three weeks before he even submitted costs, I will share the post with our 2800 members……
If this court would like to post an explanation of why it is sentencing Sharon Kramer to jail for republishing the phrase the prior courts are evidenced in this court’s case file to have framed her for libel with actual malice and with one post for which she is to be jailed not even being made by her, I will share the court’s post with the 2800 members of Sickbuildings……
If the Chief Justice of the California Supreme Court, Tani Cantil-Sayauke, would like to post an explanation of why Sharon Kramer is to be incarcerated for placing the direct evidence on the Internet, September 13, 2011, November 2, 2011 and November 5, 2011 that the Chief Justice is aware of the illegalities of these two cases by officers of her courts and its continued adverse impact on the 2800 members of Sickbuildings, I will share the post with our members……
Sharon Kramer does not have the capability to retract posts on Sickbuildings made by herself or others. As the owner and moderator of Sickbuildings, only I and my assistant, have this ability……
Until the California judicial system, Mr. Kelman and Mr. Scheuer provide an explanation of why the courts framed a defendant for libel, suppressed the evidence the plaintiff committed perjury, falsified court documents and computer entries, gagged the defendant from republishing the words for which she is evidenced to have been framed by the courts, and is now going to be incarcerate her for refusing silence of how the courts’ actions continue to harm the 2800 members of Sickbuildings; no posts of Sharon Kramer’s or any other member of Sickbuildings regarding this matter will be retracted……

It is regarding how those who currently control the purse strings for CA’s judicial branch have abused their power to practice politics from the bench in a manner that is adverse to the public’s best interest. Caught red handed by what they have been doing to Sharon, with Sharon refusing to be silenced – they are now going to incarcerate her to conceal crimes perpetrated by the LEADERS OF CALIFORNIA’s JUDICIAL BRANCH.

I applaud Sharon Kramer for refusing to be silenced!!!! I too am sick from mold illness and have the labs, reports and notes from an ENT physician to prove it! Did we have any protection, NO!!! It’s our builder’s fault but he got off scott free. We lost our home and all of our belongings and what did the system do for us? Nothing! Not to mention that I have to go out of state to get medical help and insurance won’t cover my treatment. Thank God someone stood up to the bullies. You can’t shut all of us up!
Lisa, I completely understand what you are saying and so do many others. I am so sorry you are having to go thru this. Don’t worry. We are getting there. Kelman’s attorney made a majory tactical error today!
How does one rectify in there mind arresting someone for protecting themselves with the only weapon we have. . Our voice and truth. Spend one day in our hell, where society has been brainwashed to believe, across america thousands of people that don’t even know each other with the same stories of devastating illnesses are idiotic mentally ill individuals.
I not only support these courageous people, I would share there sentence. Why, because it couldn’t be any worse than what our government and the medical field have already done.. You’ve taught us there truly are no rights unless its your rights, you’ve taught us that the value of our lives mean nothing to you. .mr and mrs I’m here to tell you… Mold illnesses is worse than being raped, I know because I’ve suffered both in my life.
You don’t scare the ones that are fighting to save their lives with your threats of jail.. It scares us knowing theres no help for such painful illnesses.
I support and commend Sharon for her truthfulness in this matter. I am a sufferer of toxic mold exposure from my place of employment over a 9 year period. Had I not been told lies that mold would not hurt me I may not be in the situation of trying to recover from t his awful chronic inflammatory syndrome. The mold exposure has been detrimental to my health and I am unable to work or leave my home at times due to the internal damage it has caused. It is time our government , doctors, employers, landlords, builders be made aware of the dangers of toxic mold and stop trying to pass off responsibility. Awareness is key…and we thank Sharon for all her work and concern for the welfare of others.
I too, Marie Moore, completely and wholeheartedly support the efforts of Sharon Kramer, Crystal Stuckey, Kevin Carstens and ALL others who are upholding truth and justice on behalf of all those who are suffering from the devastating effects of toxic mold exposure caused by water damaged buildings.

Good luck today, Sharon! I appreciate you and all that you have and will do to bring awareness to environmental illness and the cover-up in the media, the courts, and the medical community. Some day, our plight will become public knowledge… and all the people who have been told their illness is “all in their heads” will realize that it was all in their HOMES!
I never thought I would see the day in America when justice would fall to deceit and corruption but this is in fact the case here.. If Sharon goes to jail over this it will prove that our judicial system is broken and in fact,, the American way of life has been shattered. This court action may be a sign to the rest of us that we should not speak out on the miscarriage of justice but,, I suspect it will have the opposite effect.. I was feeling sick 8 years ago and took time off from work. While off from work I only felt worse. Then I went in to talk to my manager to request additional time off. While waiting to talk to my manager I realized I didn’t feel bad sitting there and I wondered, without ever hearing of anything called ‘sickbuilding syndrome’, could something in my house be causing my illness? This started my journey in to indoor air quality. Sickbuildings group, with individual help from Kevin Carstens., Sharon Kramer and many others in this group, helped sort it all out and I am in much better health now. I don’t take any medication, all I did was find and fix things in my house which had been done incorrectly. I would have never been able to do it without the generosity and good will of these good people. Sharon should not be persecuted but deserves praise for her courage. Do the right thing, least you or a loved one of yours is the next victim.
Yes, people are suffering , some even die and we, that are made ill from water damaged building exposure not only lose our health but usually everything else, many become homeless.
thanks to the lies and deceit going on over this issue most of us cant even find a doctor in our area to even try to help us. THIS HAS GOT TO STOP!

For someone who has worked so hard on behalf of we, the victims of toxic mold, the threat of incarceration for telling the truth is something that won’t go unpunished by those seeking to silence Sharon. Thanks also to Kevin, who maintains the “sickbuildings” list on which I’ve been a member for nearly as long as my illness of 16 years. While a fellow male employee received a settlement from NYS Workman’s Comp for his interstitial lung disease, I was denied anything – even a hearing on my case since my pulmonologist defected to my workplace (United HealthCare) from where he had treated me and many others while he was at Grand St. Medical. God bless and reward those of us who suffer devastating physical, emotional, and financial effects of toxic mold. All we want is a cure and to be well. That is my petition to my Lord Jesus in addition to fairness of the court for Sharon Noonan Kramer.
I too, Dana Toliver, completely and wholeheartedly support the efforts of Sharon Kramer, Crystal Stuckey, Kevin Carstens and ALL others who are upholding truth and justice on behalf of all those who are suffering from the devastating effects of toxic mold exposure caused by water damaged buildings. I, too, have been fighting a case for disability in the CA courts for the past seven years regarding my illness caused by exposure to toxic mold. It is no coincidence that I was forced to stop working June 30, 2003 due to the inability to perform my job duties and the lack of ability to function and ran in to many obstacles in seeking a diagnosis and treatments. I have no doubt that my case was denied twice and has now sat in a CA Appeals court for over two years with no judgement based on the position paper by the ACOEM authored by Bruce Kelman and marketed by the US Chamber of Commerce.
It is an absolute travesty that there are so-called humans out there that put a price tag on human life. It is down right shameful that these same so-called humans have been bought off and would rather safe face then do what is right and just!
Toxic mold exposure caused by water damaged buildings absolutely can and does cause harm! People are dying! I, along with countless others, have suffered far too long by the acts of these heartless criminals. It’s time for the suffering to STOP!
This is a national and world-wide epidemic that has been denied and covered up for far too long! This is a very serious environmental issue, health issue, political issue, judicial issue and financial issue involving massive fraud perpetrated against “We The People”; the citizens of the world! And those who are involved in perpetrating this fraud and mass cover up who have purposefully chosen to lie, stay silent and not speak up for what is right and just will be sorry they ever did when they are begging for mercy while rotting away in hell!
I want to personally thank Sharon Kramer for all of her tireless work on behalf of those suffering. I also want to personally thank Kevin Carstens who is the owner of Sickbuildings which has supported me and many others and helped us to connect and not feel so alone in our individual pligths. And last, I want to personally thank Crytal Stucky for creating this website which has helped spread the truth about this deadly epidemic.
I have 3 terminal lung diseases due to the deceit in the Chamber and I have more courage than any of those members ever had. One of my babies has died, 2 others ill. Two ill adults, on oxygen, ill and homeless. This is what your deceit has done To us to many many people all over the USA. You are guilty of mass murder of many. For that you are GUILTY.

Sharon Kramer is a very honest American and would not lie in court. These men are setting her up and so is the courts, you court people need to stop this behavior and leave her alone, forshame on your behaviors to an innocent person. We,Americans, will never forget the mistreatment of this honest,intelligent female for trying to protect our citizens of this country and keep people from getting deadly sick from black mold. I have a friend who almost died from deadly bacterial black mold so don’t tell me your lies,Sharon is telling the truth and that’s that.

My home is killing us, my pets should have been a big red flag when we moved into this dream home 5 yrs ago and they all became instantly ill. The stiff joints on me came first and foggy head. Then lyme disease a few years into it and we didnt know of the toxic molds until this past few months after testing all of our blood. Very sad and scary. Drs in all areas of the world need to be educated on this and would have been caught before I had a stroke from it. We need support groups and such to help educate people because there aren’t enough Drs out there that know what they are doing. No more people need to die from this! We are losing too many people in our support groups too fast. Someone please help us all!!
I too am a refugee of a water damaged property, where I became very ill over an extended period of time. Still almost 2 years later have issues with my health that have been almost impossible to shake. Now I have multiple chemical and other sensitivites that interfer with my daily life. Just today I had my home inspected for all pollutants that may be adversly affecting me. Stephanie A Weiss-Wood
I would also like to add that I have been sick for about 14 years working on this issue and been in the court system several times and lost every time. I am now have reactive airways disease and regular chemicals in products cause me to get sick.
My husband had open heart surgery 1 1/2 years ago and was doing fine and then they had a fire at his office the anniversary of his surgery and had water damage from sprinklers. Because of the lack of infomation his office had to work in 115 heat index while walls were being ripped out and no ac for several days. Finally someone brought in a portable unit and fans were blowing and work going on for about 6 weeks while they still worked in the office. When my husband took a few days off from work– he was fired. After working there some 44 to 50 hours over the regular 40 hours for about 4 years. We reported this unfair firing to the Labor Dept. but no one did anything.
Now my mom is livng in an HUD that has water damage/indoor mold. She is 77 and very scared. It never ends even with my knowledge I have not been able to help my husband or mom. Luckily being out of the office my husband has felt better but cannot find work. We have not been able to get proper medical treatment because this entire issue has ruined us financially from all the years of having to move, etc. to find safe housing. I have never bothered to file for SS because of all the corruption regarding this illness. I feel if the proper infomation was revealed these issues would not continue.
At least all the people involved have worked hard to try to help those suffering. I can’t believe this can happen in our great country. Linda Delp
