Mold Injured Workers File Complaints With San Diego District Attorney For Local and Statewide Workers’ Comp Insurer Fraud and Judicial Bias
On August 25th workers willing be filing workers comp complaints against the Poway Toyota dealership owner and manager for refusing to provide workers compensation for workers who were contaminated by mold at the dealership. Also other workers will present testimony about the need of the District Attorney of San Diego to prosecute criminal fraud by insurance companies and employers.

Injured workers from the Toyota of Poway dealership will be filing complaints with the Fraud Unit of San Diego District Attorney’s office on Wednesday August 25, 2010. Workers at the dealership were exposed and sickened by mold that the owners, Vincent Castro and Troy Duhon, as well as manager, Rick Gallagher, refused to acknowledge as a health hazard while placing the health and safety of the injured workers at risk.
According to the complain, these individuals, their workers compensation insurer and legal counsel have engaged in criminal schemes and intimidation of workers to shift the healthcare costs to DI disability insurance, SSI and other providers; thereby defrauding the public. This is not an isolated incident as more and more employers and insurance companies shift their costs as a result of the deregulation of workers compensation under SB 899. The failure of CAL/OSHA to enforce health and safety regulations have aided and abetted to shift the costs of injured workers and their families onto taxpayers of California.
Also testifying will be other injured workers who are fighting in San Diego for prosecution of employers and insurance companies who refuse to take responsibility for the medical and compensation costs of injured workers. District Attorneys including San Diego’s Bonnie Dumanis have a responsibility to carry out prosecutions including against employers and insurance companies as well as officials who are involved in covering up felony workers compensation fraud.
Additionally speakers will discuss the ACOEM regulations which have allowed company and corporate doctors to deny compensation for health hazards created by mold in the workplace and at homes. Sharon Kramer will be speaking of how the San Diego court system has aided and abetted this deception and interstate insurance fraud to continue five years longer than it should have. She is filing a complaint with the District Attorney’s office on Wednesday for systemic judicial bias involving ten San Diego judges and justices, including Justice Judith McConnell who is Chair of the California Commission on Judicial Performance, causing the corruption of the US Chamber of Commerce and ACOEM over the mold
issue to flourish in the San Diego, California and US courts.
Dina Padilla from the Peace And Freedom Party and Bill Balderson from the Green Party who are both candidates for California Insurance Commissioner have issued statements of support for this investigation and prosecution in the Poway Toytota case and will have statements available. Our first Damn Questions! go to Kevin H. Brown, Chief Executive Officer of the National Apartment Association (“NAA”). NAA is a political action committee located in the DC area. They respresent and lobby on behalf of multi-million dollar property management companies from across the US. Among other functions, these property management companies oversee the leasing and maintenance of multi-tenant housing of thousand of US Citizens.
The Damn Questions! for Mr. Brown are: “Isn’t it insurance fraud to present the purported environmental science of the US Chamber of Commerce to the courts in an effort to bias their decision in favor of an NAA member, while telling the courts that ‘years of intense study have failed to produce any causal connection between exposure to indoor mold and adverse health effects’…and then turn around and warn the NAA members via your blog that NAA is aware ‘mold can cause major health problems and even death. Dear Mr. Brown,
We have a blog called “Katy’s Exposure – Exposing Environmental Health Threats & Those Responsible for Them”. I think you are aware of this blog, because you were sent a certified letter on April 28, 2010 telling you of its existance and how it relates to you, the NAA and a particular Amicus Curiae brief the NAA submitted in a legal proceeding in Arizona involving new born infant deaths and an apartment building documented to have an atypical amount of mold.
On August 31, 2009, the NAA submitted an Amicus to the Arizona courts that stated:
“In a report entitled, ‘A Scientific View of the Health Effects of Mold’, a panel of scientists, including toxicologists and industrial hygienists stated that years of intense study have failed to produce any causal connection between exposure to indoor mold and adverse health effects.’ U.S. Chamber of Commerce, A Scientific View of the Health Effects of Mold (2003)”
[FYI, purported author for US Chamber who says under oath that he never even read the Chamber’s “Scientific View” even 3 years after it was published, UCLA physician, Andrew Saxon]
But on May 19, 2010, the NAA blogged a warning to its members titled “Mold: Your Silent Enemy”. This blog states:
“Remember, mold can cause major health problems and even death. Don’t let it get out of control and affect your company or your residents.”

Introducing Our New Blog – Just Answer The Damn Question!
Dear Katydids (our blog followers),
For the past 3 years, we have been providing our readers with news articles, videos, journal publications, etc, from across the US of ills in our society that allow the true devastation from environmental exposures to go unaddressed. Over the years, our readership has grown with several of our blogs now getting even higher Internet search engine ratings than some of the mainstream media who are writing on the same subject!
We are pleased that we are helping people to be more informed about ills in health policies, government agencies, the private sector and our judicial system that allow environmental illnesses to flourish. However, citizens being able to read about what is wrong does not appear to be enough to bring the changes needed. It seems that explanations from decision makers and accountability of why so much corruption is allowed to continue is required to bring true change. It is in this spirit that we are proud to announce our new, sister Blog:

Within this weekly blog, we will post YOUR questions of elected officials and others that you send to us along with the letter or fax we send on your behalf. SAN BERNARDINO – Residents of Sunset Ridge Apartment Complex say leaky water pipes and roofs have caused mold to grow in their homes.
Two say it’s resulted in vomiting, headaches and respiratory problems.
“It’s on the baseboards, the walls,” said Christine Saul. “Some of the mold you can see on the back side of the carpets. It smells like mildew.”
Saul first complained to management Aug. 14 when a pipe in a master bedroom wall began leaking. A pipe leak under the floor flooded the room, it’s adjacent bathroom and the kitchen Aug. 15.
Saul said she notified a maintenance worker who told her he could not complete the job by himself. The next day workers fixed the leak, removed some of the soaked carpet padding, suctioned water from the kitchen floor and partially dried the carpet, Saul said.
“There’s still moisture in the padding and you can smell the mold,” Saul said.
Saul says she’s suffered headaches and vomiting.
Frank Gonzales said management cut a hole in his bedroom wall to fix a leaky pipe, but immediately patched it without giving moisture time to evaporate. Management did nothing to dry water that soaked the carpet, said Gonzales’ girlfriend, Sharon French, who also lives there.
He said bathroom walls and the toilet must be cleaned with bleach every few days or the mold will accumulate.
Corwin Porter, acting chief of county Public Health and Code Enforcement departments, said mold grows in areas where moisture lingers, such as the area around a leaky pipe or a bathroom with poor ventilation. There’s not a local agency that responds to mold, but code enforcement will usually respond to the problem causing mold to grow, Porter said.
City Code Enforcement officials said the department will respond to code compliance complaints from the apartment complex.
Keishauna Williams says a leaky roof flooded the living room of her second story apartment during a rain storm earlier this year. She says management hasn’t repaired the leak, but did place a tarp over the roof. The wet carpet grew mold, she said. Since the roof leak hasn’t been fixed, she’s worried moisture that remains in the structure has caused mold to grow there.
“Everyone’s getting sick. We’ve all just been really sick,” Williams said.
She says she will call code enforcement and won’t pay rent until the roof is fixed.
“I have my rights,” she said.
An office employee at the complex at 1700 E. Date St. declined to state his name and referred questions regarding resident complaints to its parent company, Cannon Management. A secretary at Cannon’s Riverside office said a manager was not immediately able to respond Thursday.
