A Colorado Springs couple says mold in their apartment made them sick. They’re not the first to complain about the Pinnacle Apartments near Austin Bluffs and Rangewood and now they want to warn others.
COLORADO SPRINGS, Colo. — Brian Bauman and his wife, Jessica, said looks were deceiving at the Pinnacle Apartments. They said soon after moving in they got sick from mold in their apartment and around the complex.
They said they looked at a model apartment, but were told they couldn’t see their unit because it hadn’t been cleaned. On move-in day, they said they walked into their apartment to find dirty carpets and sinks, cracks in the tiles and a refrigerator that didn’t work. But more concerning, they said they discovered mold.
They snapped pictures of mold in their apartment, in a neighbor’s apartment and at other areas in the complex. They said their sickness began almost immediately.
The couples’ doctor agreed that the symptoms were likely from mold exposure.
“He suggested we not return to the unit, and we took his suggestion,” said Bauman.
The couple isn’t the first to complain about mold at the Pinnacle. In the past, KRDO NEWSCHANNEL 13 has spoken with other families who said they had to move out because they got sick from mold, as well as residents who showed us leaking water pipes and holes in the ceiling.
On Saturday, our producer posed as a prospective resident to ask about mold problems.
“Has there been any water intrusion or mold problems?” he asked. “Nope,” replied the leasing agent.
The manager at the Pinnacle Apartments said she had no comment for this story. She referred us to a supervisor at Resident Management Systems. That person didn’t return multiple messages.
Resident Management Systems has billed Brian and Jessica almost $7,000 for breaking their lease. The couple has hired a lawyer and are teaming up with other former residents to pursue a lawsuit.

An experienced and successful lawyer in Temecula, California, John Mittelman can demand up $450 an hour for his services, but he and a colleague, April Blackwood, spend dozens and dozens of pro bono hours representing tenants who live in some of southern California’s nastiest, slummiest apartment buildings.
Attorney John Mittelman: “I have clients who put toilet paper in their ears…to keep the cockroaches from crawling in.”
“These apartments are infested with mold and mice, the doors don’t lock, there are stoves that don’t work, no hot water, just fill in the blank,” says Mittelman. “I have clients who put toilet paper in their ears and noses at night to keep the cockroaches from crawling in. There are mice and other vermin nibbling on their children’s fingertips while they sleep.”
“These are people that don’t have money for first and last [month’s rent] and security deposit to move out of these places,” says Mittelman. “And if they did, they would most likely find themselves in another building owned by this same company.”
PAMA management is one of the largest apartment owners in the Los Angeles and San Bernardino area. The company is owned by Swaranjit “Mike” Nijjar, who Mittelman says, lives like a “slumlord millionaire”, throwing lavish parties in his palatial home while his tenants live in squalor.
“PAMA is raking in up to $850 a month from hundreds of tenants,” says Mittelman. “And PAMA never really paid for these buildings in the first place, because of all the tax breaks and it really isn’t interested in maintaining them.”
Sometimes other PAMA tenants hear that a lawyer recently helped out a tenant and will ask Mittelman to help.
“We can go into court after they have moved, or even while they are still there and sue the landlord for emotional distress, pain and suffering that goes along with living in a cockroach infested, mold infested place with no heat,” says Mittelman.
“Sometimes we go to court and get nice judgments for these people and they can walk away with a sizeable amount money–and maybe then we would take an attorney fee.“ But the more likely situation is what Mittelman explains next.
Some tenants get so frustrated by the landlord’s slow-to-act maintenance service and a system that either doesn’t have time or money these days to force landlords to maintain buildings, they just start withholding rent without consulting legal advice.
The landlords can then issue a notice to pay in three days—or get out.
“These are people who just came to the end of their rope,” says Mittelman. By the time they get legal advice, the best that can be done is to negotiate a “walk away” as it is called.
“We don’t see any money for that,” says Mittelman. “And we don’t expect it. These people certainly don’t have enough money to pay us, so that’s the pro bono end. We will get 45 days grace and sometimes a waiver of the rent that is due—so these people can move on.”
Unfortunately, things often just get worse them. “Now they have a judgment against them,” says Mittelman. “They often don’t have good credit in the first place and any potential landlord is going to look at those judgments and want more rent because they are considered a risky tenant or they are not going to rent to them at all.”
PAMA Management and its apartment buildings have been in the news a lot in California. The company says that tenants often don’t look after the property—and that’s why there are problems.
That is not how John Mittelman sees it.

Video – EPA workers say North Carolina building making them sick despite attempts to fix problems – Research Triangle Park, NC

RALEIGH, N.C. – When it opened in November 2002, the Environmental Protection Agency’s campus in Research Triangle Park, N.C., was touted as a state-of-the-art facility.
It contains more than a million square feet of labs and offices, where some of the top researchers in the U.S. work to improve the quality of the nation’s air, water and land. But there’s one problem nobody at EPA has been able to solve: Air pollution in the EPA’s own offices is making staffers sick.
An investigation by WRAL-TV in conjunction with the Investigative Reporting Workshop, found that soon after the building opened, EPA employees began complaining that contaminated air was causing a range of health problems, among them, asthma, shortness of breath and eye trouble. Although the agency has taken numerous actions to try to fix the situation, some staffers say it is still risky for them to go to work — and have had to get permission to telecommute from home. Others continue to work in the affected building, but believe their health is suffering.
“You’re having throat problems. Your eyes are watering. You’re having, possibly, difficult breathing,” said Silvia Saracco, the president of the union that represents many of those workers. “They want to come to work. They want to do their jobs. And their health is being negatively affected. They’re having a hard time breathing.”
A report done in 2009, written by an EPA contractor and obtained by the Investigative Reporting Workshop, highlights years of problems dating back to 2003. At that time, laboratory staff reported “excessive indoor particulate levels,” i.e., toxic dust, some of which was contaminated with metals. Since then, the report noted, workers in two buildings reported symptoms, including coughs, eye irritation and chest pain with inhalation after a “dump” of particulate matter occurred. “Some individuals had persistent symptoms for many days prior to eventual resolution, and some had symptoms recur when they tried to return to their usual laboratories,” the report said.
The study focused chiefly on Building-B, which consists of laboratories and office space. It concluded that the complex did not have “Sick Building Syndrome,” but acknowledged that some workers were likely suffering from “Building-Related Symptoms.” The report also called for additional sampling of indoor air contaminants.
EPA employees interviewed by the WRAL and the Workshop asked not to be named, for fear of retaliation by EPA officials. One said it’s still common for small pieces of rusted metal to fall out of the air and land on computer keyboards. Surfaces in labs and offices often look like they have a thick coating of dust. It isn’t typical office dust, however. Tests showed the presence of metal and glass fragments that were not found in the air outside of the buildings.
Inside, the air has been so bad that electrical components of some lab equipment have corroded. The damaged equipment was fixed quickly, but the cause of toxic particulates contaminating the equipment remained elusive.
