I will post more on the false information by Riverstone Residential and the evidence our unethical attorney chose to NOT to pursue along with not correcting wrong information sent when subpoenaed.  But then, this is the reason I have the 2007 Mold Inspection Reports done when the complex was sold then totally IGNORED.  Also, there is the subpoena to the wrong company so evidence would NOT be sent.  This document is filled with wrong information – minor to major – all because our attorney spent so little time on it because the plan was for this to get dismissed.  See – Attorney Malpractice

Anyone with half a brain and some common sense can read the documents on this site and view the photos and see that mold has been a huge problem at Jefferson Lakes Apartments and they know about it and try to hide it.

This extreme infestation of molds filling these apartments with toxins will be allowed to continue spreading at this complex while making many more sick (not to mention all the previous tenants) just as the corruption in this litigation spread to involve so many.  This is all just fine with the owners, Riverstone Residential, the Louisiana Housing Finance Agency, and the State of Louisiana.

Our health was violated by the owners of these buildings and Riverstone Residential and then our rights were violated by an unethical, lying, sorry excuse for an attorney – J Arthur Smith III and the unethical, corrupt justice system in the corrupt State of Louisiana.

This is not over at all.

Redwood City group – JB Matteson buys 146-unit complex in WA – Riverstone Residential to operate & lease the complex

Redwood City-based JB Matteson has acquired the 146-unit London Flats Apartments in Vancouver, Wash., for $12.1 million, or $83,000 per apartment.

The newly-constructed 165,371-square-foot complex at 7531 NE 18th St. in Vancouver, a suburb of Portland, Ore., will be renamed the “Addison Apartments.”

JB Matteson acquired the property through a bankruptcy trustee. The property was acquired on behalf of a group of private investors. Hendricks and Partners were the listing broker. Freddie Mac provided an acquisition loan for $8.2 million.

“London Flats is an example of our West Coast investment strategy to acquire newly built multifamily projects at a steep discount to actual development cost,” said Graham Chernoff, senior vice president of investments for JB Matteson. “Since London Flats is being purchased out of bankruptcy, there is considerable upside by leasing up vacant units and achieving higher rents by completing common area improvements.”

London Flats was built by a local builder and originally intended for personal long-term ownership, but was put up for sale when the developer was forced into a bankruptcy. Constructed in 2008 and 2009, the property is composed of 16 two-story, garden-style apartment buildings and one clubhouse and recreation room. The 146 residential units provide a mix of one-, two- and three-bedroom apartments ranging from 700 square feet to 1,398 square feet. The 6.75-acre property has 29 garages and 235 open parking spaces.

JB Matteson is a multifamily investment specialist with $1 billion of multi-family, office, retail and mixed-use properties, including over 4,000 apartment units in the Western United States. The company partners with institutional investors on value-added investments and performs as investment manager for private capital investors.

JB Matteson has hired Riverstone Residential to operate and lease the complex.

Jury awards $3.7 million in medical malpractice lawsuit – man dies after contracting blastomycosis (fungal infection) – failed to run basic diagnostic tests

A Brown County jury awarded the survivors of a deceased farm worker $3.7 million Friday in a medical malpractice lawsuit.

Gustavo Espinal-Santos died Jan. 1, 2004, after contracting blastomycosis, a fungal infection often transmitted through water or soil.

James Sickel of Hinkfuss Sickel Petitjean & Wieting said Espinal-Santos twice visited the Bellin Family Medical Center in Bonduel in December 2003 complaining of illness. Sickel said Espinal-Santos was seen by physician assistants who determined he had pneumonia. He said they failed to run basic diagnostic tests, specifically X-rays..

He was admitted to St. Vincent Hospital on Dec. 23, 2003, and diagnosed with blastomycosis, but too late to save his life, Sickel said.

After a four-day trial and about eight hours of deliberation, the jury found Bellin Health System and Dr. Peri Aldrich, who was responsible for overseeing the physician assistants, were negligent.

Sickel said the award will be reduced because of award caps in Wisconsin law.

Espinal-Santos’ survivors include his wife, Maria Zavala McDaniel, and daughters Maria Espinal-Zavala, 10, and Anna Sophia Espinal, 5.

Bellin Health issued a statement Friday on the verdict.

“Foremost, Bellin Health wishes to express our empathy to the Santos family. It is difficult any time you lose a family member. Bellin Health is obviously disappointed with the verdict and believes the care provided was appropriate and followed established medical protocols. We are now determining what, if any, other action will be taken in this matter. Out of respect for the privacy of the family, we will have no further public comment.”

EEOC Files Disability Discrimination Lawsuit against RIVERSTONE RESIDENTIAL / REALTY MANAGEMENT

Federal Agency Says Company Fired Successful Worker Because He Had a Disability

PHOENIX — The U.S. Equal Employment Opportunity Commission (EEOC) announced today that it has filed a disability discrimination lawsuit against Phoenix-area property management firms Riverstone Residential, SW, LLC and Realty Management, charging the companies with firing and failing to accommodate an employee because he had a disability.

According to the EEOC’s suit, EEOC v. Riverstone Residential, SW, LLC; Realty Management, CV-09-02038 PHX-JAT, filed in U.S. District Court for the District of Arizona in Phoenix, Realty Management / Riverstone Residential hired Shaun Oldridge, but on or about March 21, 2008, Oldridge informed Realty Management that he had been involuntarily hospitalized, whereupon Realty Management unlawfully discharged him. The suit further charged that during his employment, Oldridge requested on a number of occasions to have one hour off to see his health care provider. Each request for this reasonable accommodation was unlawfully refused, the EEOC said.

Such alleged conduct violates Title I of the Americans With Disabilities Act (ADA), which prohibits private employers, state and local governments, employment agencies and labor unions from discriminating against qualified individuals with disabilities in job application procedures, hiring, firing, advancement, compensation, job training, and other terms, conditions, and privileges of employment. The ADA covers employers with 15 or more employees, including state and local governments.

The EEOC filed suit after exhausting its conciliation efforts to reach a voluntary pre-litigation settlement. The agency is seeking monetary relief including back pay with pre-judgment interest, compensatory damages, and punitive damages. The Commission is also seeking an injunction prohibiting future discrimination and any other curative relief to prevent Riverstone Residential from engaging in any further discriminatory practices.

“People with disabilities are an untapped resource that employers should utilize,” said EEOC Regional Attorney Mary Jo O’Neill. “Many disabled persons are qualified, ready and willing to work — all they need is an equal opportunity. Cases such as these are important to society because they confirm that workers who want to work, but are prevented from doing so by employers because of a real or perceived disability, are protected by the law.”

Rayford O. Irvin, acting district director of the EEOC’s Phoenix District Office, added, “We will continue to vigorously pursue our mission of fighting employment discrimination on all fronts. We encourage employers and employees to sit down together and cooperate to find an accommodation that works for all parties involved, regardless of the disability.”

The EEOC is responsible for enforcing the nation’s laws prohibiting employment discrimination. The EEOC’s Phoenix District Office has jurisdiction for Arizona, Colorado, Utah, Wyoming, and part of New Mexico (including Albuquerque). Scientists from SUNY Cortland & Cornell University to give presentation on how mold & other fungi impact the lives of humans

Their topics will range from fungi that cause human disease, molds in houses, mushrooms and mushroom poisoning to the key roles of fungi in global ecosystems.

A pair of scientists from SUNY Cortland and Cornell University will give a presentation on how mushrooms, mold and other fungi impact the lives of humans on Thursday, Nov. 5, at SUNY Cortland. 

The Community Roundtable, titled “Fungus Among Us: Mushrooms and Molds in Our Lives,” takes place from 8-9 a.m. in SUNY Cortland’s Park Center Hall of Fame Room. Refreshments will be served at 7:45 a.m. Sponsored by the President’s Office and the College’s Center for Educational Exchange (CEE), the community roundtable is free and open to the public.

Fungi are interesting and diverse and, with a few exceptions such as athlete’s foot, yeasts and blue cheese, are not well known. Timothy Baroni, SUNY Cortland distinguished professor of biological sciences, and Kathie T. Hodge, associate professor of plant pathology and plant-microbe biology at Cornell University, will discuss the effects of fungi on people and the planet. Their topics will range from fungi that cause human disease, molds in houses, mushrooms and mushroom poisoning to the key roles of fungi in global ecosystems.
