Multi-Housing News Blog – Stimulus Package for your Complex – Riverstone Residential – Cheap Entertainment

‘Guest Blog’ with Scott Yahraus: Stimulus Package for your Complex

June 16, 2009

From the article –

In this month’s issue of Multi-Housing News, Christy Freeland, CEO of Riverstone Residential said, “We know that people like to be social, so we’re offering things like movie and game nights, or bringing in guest speakers on topics like physical fitness. We’re not having to spend a lot of money on those things, but it’s the idea of providing a sense of community that will keep residents around longer.” (MHN, June 2009, pg. 13)

I could not agree more with Freeland. Your residents are your customers, so it is wise that you treat them well. To me, this means going above and beyond giving them a clean and safe place to live. Goodwill goes a tremendously long way.

ABOVE AND BEYOND A CLEAN SAFE PLACE TO LIVE???  Not Jefferson Lakes Apartments in Baton Rouge, LA managed by Riverstone Residential. The mold infestation there is unbelievable.  In fact, I have heard it described as one of the worst ever seen after testing results. Yes, I’m sure some cheap entertainment is just what their “customers” need.  katy

CALL TO ACTION! “MCS” Beacon of Hope “Enough Is Enough”

Dear Friends,

This is important ~ if you have been exposed to air pollution, mold, toxic metals, pesticides, chlorinated products, “air fresheners” (petrochemical derivatives) toxic cleaners and other chemicals found in homes, schools, work places, and environment ~ this concerns you.

If we are to ever be allotted the same rights, respect, support, acknowledgment, and help allotted to other illnesses & disabilities we must join forces, we must stand together and support one another and we must make our voices heard. We must present ourselves united for the good of all. As we each fight our related battles, we must work together to gain more political power and to move our society toward our collective goals.

For far too many years, there have been numerous attempts by various individuals and groups to get our government officials, our medical professionals, our bosses, teachers and administrators, businesses, our landlords, and yes even our neighbors and loved ones to acknowledge and address a set of illnesses which is plaguing millions in our country and around the world.

As we all know, there is a vast amount of symptoms & conditions that fall under Toxic Injury. Toxic injury applies to any illness, which stems from being exposed to toxic substances. The plethora of toxic chemicals that mold produces is causing many to become seriously ill all around our country & the world. Recently at the last meeting in regards to the GAO’s mold report, the CDC’s infectious disease division, decided not to participate and follow the GAO’ recommendations. We must turn this awful tide. In order to do so, we must speak even louder. This is why it is just as important that we also recognize all our brothers & sisters who suffer from similar ailments that have been derived from toxic sources. “Toxic Injury” denotes cause and effect. Toxic chemicals, spills and pollution adversely affect our food chain, our water supply and the very air we breathe and if you can’t breathe ~ nothing else matters. It is time for us all, to come together!

Our charitable organization is fighting to bring to the attention of all government leaders, the horrific consequences of consumer product and environmental toxins. Individually and as groups, we have informed those in key positions that toxic exposures are serious to life threatening; that mold infestations, our personal care and cleaning products, our building supplies, pharmaceuticals, even our baby products, etc contain and emit very toxic, very dangerous and unnecessary chemicals.

Years ago, with this knowledge, the “MCS” Beacon of Hope developed a proclamation, which serves to help bring awareness & education for these very issues. We have successfully received signatures of support from over half of our countries governors with more on the way. This petition and proclamation serves all. It brings us together with one immensely loud voice, which in turn will force quicker action and resolution.

Congress is aware of our needs but the only way to confirm how many are suffering and that this crisis demands and deserves their immediate and undivided attention is to show them in black & white that we are fed up and want action taken now. We all need to join together with one concerted effort to get this issue heard.

Please join us in signing the petition, which will tell our leaders loud and clear “Enough Is Enough”. With this said, the most important voice needed to usher in success is yours. Please, help STOP THE POISIONING!  Go to the link below now and add your signature, express your concerns and let your voice be heard:

For the newly “injured” or “concerned”:

If you are wondering if these toxic chemicals are affecting you, a review of some commonly associated symptoms is in order: Toxic injury is not only life changing but is often life threatening. Those with toxic injuries/disabilities become functionally impaired, and can affect the way one acts, speaks, writes, perceives or carries out a simple task. They may suffer non ending flu like symptoms, memory loss, hair loss, ramped tooth decay, sleeplessness or insomnia, obesity or unexplained weight loss, behavioral changes, weakness, dizziness, confusion, reoccurring nausea, skin rashes, metallic taste in mouth, irritated eyes, ears, nose, throat, severe sinus and/or migraine headaches, aching joints and muscles, chemical sensitivity and this list goes on. Many might say this can pertain to a lot of illnesses. That is the exact point.  Science is increasingly showing that many and most human illnesses can be linked at the footsteps of chemical exposure be it by ingestion, inhalation or absorption.

There are others with even more severe forms of Toxic Injury such as cancer, leukemia, Parkinson’s, and Alzheimer’s, just to mention a few. Of course, diabetes, arthritis, IBS, skin diseases, fibromyalgia, and the many autoimmune diseases associated, are no picnic either.

Some of you may be unaware that another dominant source for toxic chemicals is mold. Several species of molds produce a plethora of toxins that are extremely hazardous to human health. Due to the lack of regulations safeguarding us against mold or other toxic chemicals in our environments, millions have fallen ill with many more just one breath, one exposure away from avoidable illnesses, disabilities and/or premature death.

Friends, we are in a fight for our very lives and those of future generations. Positive change is happening but it will not happen overnight. The fight to rid our planet from the production of these toxic substances will be long and hard. We must educate those in power to realize that toxic chemicals (not all chemicals are toxic) are the route cause and Avoidance must be our first line of defense.  At present there is no known cure for these illnesses. Toxically induced illnesses cannot be treated by throwing more toxic chemicals at the toxically injured/disabled. Safer choices, products and practices are readily available, effective and cost efficient.

If we can be of assistance to you, please do not hesitate to contact us.

We thank you in advance for your anticipated signature and support!

Sincerely, your friend in Hope & Health,

John

Recap Advisors Tops $2.0 Billion in Assets under Management

Business Wire ,  May 1, 2008

Recap Advisors, respected provider of financial services on multifamily assets, expands its work in the condo market

BOSTON — Recap Advisors, LLC, a Boston-based multifamily firm that is the financial services division of Consolidated American Services, announced today that with its most recent expansion of activity, the company’s loan assets under management have topped $2.0 billion. The newest assets are condominium loans located throughout the country.

Recap’s proven expertise in recapitalizing existing properties via its Recap Workout Group and its affiliation with Riverstone Residential, the nation’s largest independent multifamily apartment manager, make the company a natural choice for capital providers seeking to protect their positions in this complex asset class.

“Asset management of condo loans mixes reporting and tracking expertise with real estate knowledge,” said Cameron Booth, Vice President, Director-Special Assets at Recap Advisors, and the designated executive on this contract. “You have all types of condo loans – some with affordability, some with income mixing, some with special targeting like medical, retail and special purpose housing. It’s both detailed and tricky work, and to do it right you have to have financial, real estate, and operational experience on one platform. Not many asset managers do.”

The institutional client also sought to use Recap’s proprietary asset modeling and reporting system, which includes market assessment, property positioning, loan performance, and asset viability.

“Condo loans are an unusually complex financial asset,” said David Smith, Recap’s founder and CEO. “You have to know when is the moment to act, and act quickly and correctly when the time comes. Properties that are planned as condos can revert to rental, or can be partially rental along the way – and you can make money in either scenario, if you have the right strategy, execute it properly, and have the time horizon to recover the intrinsic asset value. Asset management is what we do, and we bring or build all the capacities and tools we need to handle any type of multifamily asset.”

In the coming weeks and months, Recap expects to take on other large complex asset portfolios based on discussions now in process with several national financial institutions.

About Recap and CAS. Consolidated American Services (“CAS,”) is the American property services company of UK based Regis Capital Ltd. Since 2006 the company has provided the real estate industry unparalleled services in property management, construction, maintenance, asset management, financial services and insurance services.

Recap has successfully completed recapitalization, underwriting, and sales transactions totaling over $2.5 billion, on more than 800 properties in 44 states, and currently asset-manages a portfolio in excess of $2 billion.

Riverstone (http://www.riverstoneres.com/) is largest independently owned pure third-party property services firm in the United States. Riverstone manages more than 890 properties, with more than 188,000 multifamily units and over 185 million square feet. Home Inspections – Mold Reporting vs Protecting Big Business Interests over Human Life – Recommendations Proposed by Teresa McCormick – Microbiologist

In the state of Washington, there are no guidelines or laws, which force home inspectors to report findings of mold.  Due to this Teresa McCormick who is a microbiologist for the United States Army has suffered immense financial losses not to mention becoming very ill due to the amount of mold, which went intentionally unreported when she purchased her home.  To this day home inspectors (except for a few) argue and lobby against the reporting of mold infestation.  Below is what Teresa authored and proposed to her state legislators.  Unfortunately the corporate interests and inspector organizations lobbied effectively against this proposal and to this date, no one purchasing a house will be told if it contains mold.

Toxic Indoor Mold Central

ARGUMENTS FOR HOME INSPECTORS REPORTING OF VISIBLE MOLD

Large amounts of mold in homes have been associated with infection, irritation, allergy and toxic reactions amongst residents.  This has been recognized by both the EPA and OSHA.  EPA has long recognized the phenomenon of Sick Building Syndrome.

The percentage of the population possessing the HLA DR gene which is associated with diminished ability to clear toxins from the body is approximately 25 percent.  The variants in the MET gene which doubles the risk of Autism are found in 47 percent of the population.  This gene modulates the nervous system, gut and immune system. The activity of the MET gene is affected by oxidative stress- the damage one sees with excessive exposure to toxins. Environmental toxins and the inability to clear them are associated with the 1000 percent increase in autism.  The steep rise in autism parallels the use of Oriented Strand Board in homes beginning in 1979.  OSB is tested for off gassing of Volatile Organic Compounds when dry but not when moist.   Moisture almost always results in the growth of mold even in the most expensive OSB used in homes.

CDC has delineated persons who are known to be more susceptible to mold in their 2005 Post Katrina Report.  These include adults over 65, children under 12, pregnant females, immunosuppressed patients including those with cancer, transplant patients, arthritis patients, asthmatics and HIV patients.  This growing portion of the population would be unaware of large amounts of mold in their attics and crawlspaces of the homes they purchase or rent unless reported by the home inspector.  The risk management idea that mold need not be reported because it only affects a few sensitive people and the costs to our major industries would be too great reeks of Social Darwinism where we should not care about the minority or disabled.  It is wrong on the basic principles our nation is founded on and it is wrong that it is only a few sensitive people.  In some cases we do not know when or if we might fall into one these groups, but surely we all realize we will be, with any luck, 65 some day.  RISK MANAGEMENT SHOULD BE CENTERED ON PREVENTION THROUGH REPORTING VISIBLE MOLD WHEN FOUND NOT COVERING UP THE FACT THAT IT EXISTS WITH THE IDEA THAT IT DOES NOT CAUSE STRUCTURAL CONCERNS.

The WSDA mold guidance document for home inspectors is false.  The statement that mold and mildew do not cause structural concerns may  have been taken as a simple typographical error omitting the word “surface” before mold except that the WSDA official overseeing home inspections is currently teaching home inspectors along with Jeff Morrell, who is also paid by the Wood Products Association, that mold need not be reported on home inspections as there are no structural concerns.  The same WSDA agent overseeing home inspections is then attending meetings of the American Lung Association and stating that mold and mildew rots everything it grows on and is a hazard and needs to be removed.  These efforts to lessen the importance of mold by our State match nationwide efforts.  It is no coincidence that Weyerhaeuser the largest builder in the Western States is located in Washington and is the subject of a mold class action lawsuit. Their concerns with mold first began in 2002 when many of their newly constructed homes were found to fill rapidly with mold.

Physicians treating asthmatic or neurologically impacted patients are fearful of speaking openly about the issue of mold and health for fear of loosing grants, their medical licenses and their employment at Universities funded by big industries.  Most publications showing associations between mold and health are published in Europe and Brazil. These peer reviewed publications showing the dangers of molds and mycotoxins exceed the publications by the PhD and MD group associated with Veritox by a thousand fold or more, yet the Veritox or ACOEM papers are flaunted nationwide where mold concerns are raised. While the CEO of Weyerhaeuser was amassing huge amounts of personal wealth to the tune of 13 million a year during the sub prime fiasco enabling the sale of thousands of Weyerhaeuser shoddily constructed homes to be sold, the cover up went on with the assistance of many high powered legislators and governors, while others were apparently kept in the dark.  IT IS TIME FOR THIS COVER UP TO END.  Our future is at stake.

The Kingdom of Fungi consists of three basic groups the mushrooms or basidiomycetes, yeasts and molds.  Yeasts are single celled fungi that reproduce by budding and molds are mycelia producing fungi that reproduce both sexually by fruiting bodies and asexually by means of conidia.  Some fungi are dimorphic and produce both yeasts phases and mycelial growth patterns depending on environmental factors. There are many mycelia producing Fungi or molds that cause soft rot in wood.  One of the most common is Chaetomium.  It was the most common genus found in New Orleans both above and below the water level in damaged homes after Katrina.  There is no way a home inspector has the means of telling this soft rot fungi or mold or other soft rot fungi or molds from surface growing molds on a visual inspection.  The differentiation of these molds is performed by trained mycologists using microscopic means.  These organisms often grow totally through a sheet of OSB, destroying the internal structure and strength long before the white softened areas appear.

No proven causation and no standard does not equate with No Harm. Many toxic and carcinogenic agents including alcohol and tobacco only have an association with illnesses such as lung cancer, COPD, Asthma and fetal alcohol syndrome.  There is no minimum standard or LD50 associated with tobacco smoke, yet the precautionary principle has led us to regulate tobacco out of public places and warn against alcohol during pregnancy because of an association.  Mold is a known trigger for asthma.

From the American Lung Association of Washington:

More than 5,000 people are hospitalized every year- more than 100 every week- as a direct result of asthma; more than half the hospitalizations are paid for by Medicare or Medicaid. About 48,000 adults with asthma make at least one emergency department visit per year.  100,000 make at least one urgent visit to see their doctors for worsening asthma symptoms each year.  Direct medical costs for asthma in Washington are about $240 million per each year.  Youth with asthma miss school because of their condition, and those with more severe asthma symptoms are less likely to have high academic achievement than youth with few symptoms or those without asthma. About 120,000 Washington youth are currently affected by asthma. Between 1995 through 2002, more than a thousand claims were paid by state worker compensation funds for work-related asthma totaling $12 million.  In total, asthma costs more than $400 million every year in medical expenditures and lost productivity for the state. Washington’s asthma prevalence has been identified by CDC as one of the highest in the nation- both youth and adult prevalence are significantly greater than national averages.

The chronic inflammation resulting from long term inhalation of mold spores has an association with many other chronic conditions such as thyroid, heart, liver, joint and kidney disease.  Cytokine release by macrophages which results from fungal exposure can cause goiter. Chaetomium and Stachybotyrus are both associated with demylination of the nerves and development of Multiple Chemical Sensitivity. Many molds produce neurotoxins.  The rate of Multiple Sclerosis is very high in the northwest and Canada. Washington also sports the dubious distinction of highest rate of death by Alzheimer’s disease another neurological disorder. Toxicological studies have demonstrated that inhalation versus other routes of entry with trichothene exposure tends to have greater toxicity at lower doses.

There are existing standards for reporting the amounts of visible mold given by OSHA.  These parallel reporting by New York City Standards.  Why is it that the standards exist for the workplace where mainly adult brains exist for 8 hour periods while ignoring the homes where the most vulnerable of neurological damage can occur in the developing brains of children under 5 years of age exist for 24 hours per day?  Autism syndrome has been reported in approximately 25% of children examined by Dr. Kaye Kilburn for toxic mold exposure versus <1% in the general population of the same age group.

Mold victims are victimized twice.  Not only are mold victims faced with the huge financial burdens of health problems, home repair problems but if they feel they have no other choice but to seek legal help, they are again victimized by the legal system. Few victims receive if they do reach a court room after long delayed settlements enough money to pay for attorney’s fees and home repairs and medical costs.  Often they are left homeless with no means to pay for very costly legal bills while their health concerns go untreated.  The only way to prevent this is by reporting mold when it is present so that the consequences can be avoided and attorneys are not enriched at the cost to the innocent.

The cost belongs to the seller or builder who is the cause of the moisture problems either through poor maintenance or poor building practices. It does not belong with the innocent purchaser of the property or unknowing renter.  Becoming ill should not be the first indication that there is a mold problem.  Although the State claims it is the responsibility of the seller to report mold, the seller can claim he never went into the attic or the crawlspace.  The purchaser who is relying on the standard of the industry in that most inspectors are reporting mold has no idea he or she may or may not (at the discretion of the inspector) be told about the presence of mold. THE BUYER AND THE TENANT HAVE A RIGHT TO KNOW OF VISIBLE MOLD.

The present mold guidance policy which has been in existence since March of 2003 and is little known in the real estate community or apparently in the inspection community is counter to existing legislation.  Chapter 59.18 RCW Residential landlord-tenant act Finding 2005c465: “The legislature finds that residents of the state face preventable exposures to mold in their homes, apartments, and schools. Exposure to mold, and the toxins they produce, have been found to have adverse health effects, including loss of memory and impairment of the ability to think coherently and function in a job, and may cause fatigue, nausea, and headaches.

As steps can be taken by landlords and tenants to minimize exposure to indoor mold, and as the reduction of exposure to mold in buildings could reduce the rising number of mold-related claims submitted to insurance companies and increase the availability of coverage, the legislature supports providing tenants and landlords with information designed to minimize the public’s exposure to mold.” [2005c465.]

It is not the concern for liability of the inspector or the protection of the insurance company that the guidance policy was put in place. What would be the larger suit, that of a harmed child or that of an inspector who did erroneously report mold?   The policy was put in place to protect the Wood Products and Building Industry for the sale of a known poor product and known shoddy construction and to prevent the slowdown in the sale of homes. Protection of the inspector’s liability is a ruse for surely reporting mold is a preventative measure of what would be a much larger lawsuit.  Expenditures for medical insurance companies often occur for the remaining of the victims lives through asthma care and other long term illnesses so surely the cost to insurance companies can not be the reason for the do not report mold policy.

A Home when it becomes uninhabitable is not just an economic loss like a stock or bond.  To the greater majority of Americans, when a home is lost all the hopes and aspirations of that family is lost.  The children will not have a safe place to eat, sleep or study.  Grandparents are separated from their extended families at a time when they need them the most. The dreams of saving for a college education are lost not just because of health issues when children are neurologically damaged, but because of the overwhelming burden of legal fees, health care, repairs and remediation. Families are split apart by economic crises and often blame each other.  This crisis means little to someone with a 13 million dollar income or seven homes cared for by others.

Washington State has the dubious distinction of being the highest state in the nation for breast cancer.  Aflatoxins have been found to induce malignant changes in human breast tissue.  Cyclosporin (a mycotoxin ) causes breast cancer in humans.  Breast cancer has been induced in rats exposed to T2 toxin of the mold Fusarium.  Many of the mycotoxins produced by molds found in moldy home are also used as immunosupressants for transplant patients to prevent their own body moldy homes are more prone to infections of all kinds be they pulmonary or urinary tract infections. Surely the precautionary principle alone here should allow that we report the presence of large amounts of visible mold in areas not normally seen by habitants such as crawlspaces and attics.

In the medical field we work by a few golden rules. One of them is never withhold information from a Physician that could impact the care of his patient. Even where a policy or rule exists using this golden rule fills in the blanks where common sense and empathy should prevail.  If a patient is on an antibiotic not normally reported by written rules, and if the organism infecting his blood or spinal fluid is resistant to that antibiotic, it is crucial that we immediately notify the physician.  Someone’s life is at risk.  It is not much different in the arena of the home inspection profession.  Even if the State comes up with a decision to protect big business interests over human life, it is hoped the profession will side with empathy, common sense and justice for their customers.  Listening to the inspectors here I can only see for the large part that does occur.  Eliminating the conflicts of interest such as realtor recommendations of inspectors will open for all the ability to make these choices more freely.  I only hope that I have given what I can to an educated decision on your recommendations.

Thank you all sincerely for this opportunity.
Teresa McCormick

County Can’t Get Story Straight on Toxic Mold in Public Housing Units

Another Family Caught in the Web of Corruption & Ignorance

This is the torture that innocent families are going through. While
being ill, this family as well as many others across this country are
combating corruption, ignorance, which in the end this families health
and possibly entire future will be plagued with hardship due to this.
Since when can a doctor determine what levels are toxic. Most doctors
either are not educated or deny that mold makes people ill. I hope
this family gets out of there NOW!

The molds listed in this story are toxic and besides causing
respiratory problems, they can damage the liver, kidneys, central
nervous system, and every other system in the body. This is why we
must all work together to end this corruption and ignorance.

County Can’t Get Story Straight on Toxic Mold in Public Housing Units

By Bryant Furlow
SUN Staff Writer
June 4, 2009

Rio Arriba County officials claim their low-income public housing
units do not have toxic mold despite County-commissioned lab tests
identifying at least four mold species listed by the federal
government as species of particular concern in four units.

“Toxic mold was not evident,” County Public Housing Director Angie
Pacheco told County Commission Chairman Elias Coriz at a May 28 Public
Housing Board meeting. “There were no signs of mold at all in (James)
McConnell’s unit. The inspector found black mildew on windows in the
other two units (inspected).”

James McConnell and Suzanne Tattan live in unit 110 of the Ojo
Caliente low-income housing development. They fell ill with swollen
eyes, flu-like symptoms and respiratory problems two days after moving
in, according to a lawsuit the couple filed May 27 in federal District
Court.

The Authority is seeking to evict McConnell and Tattan because of
McConnell’s allegedly aggressive and harassing behavior when
confronting Housing employees about his health concerns regarding the
mold.

“A certified person found no mold,” Coriz told McConnell at the
Housing Board meeting. “We tried to make sure that mold is indeed not
happening. I don’t want people living in mold so I gave a very serious
directive (to Pacheco).”

Coriz backtracked somewhat when McConnell produced photographs of
dense growths of mold from behind his unit’s bedroom wallboard.

“We’ll definitely have to revisit the testing,” Coriz said. “But
currently, we have the problem that I don’t have any documentation
that there is mold. We took direction from Ms. Pacheco and the report
came back negative. There’s no mold until it’s proven otherwise.”

But the County’s own lab results show that the tests for mold were
not “negative.”

The Authority paid Rio Rancho-based Rhoades Environmental $1,900
to test for mold (fungus) in three Ojo Caliente housing units — units
103, 110 and 112 — and in Tierra Amarilla housing unit 119, County
documents show.

Lab reports dated May 17 showed that all four units had species of
mold — Penicillium, Aspergillus and Cladosporium — listed by the
Agency as “species of particular concern.”

Exposure to these species can cause nasal congestion, runny nose,
sneezing, conjunctivitis, lacrimation, wheezing, chest tightness, and
shortness of breath, according to the Agency’s web site.

“Among patients studied, children are the most sensitive to mold
allergens,” the Agency web site states.

There are currently no federal regulations governing mold
exposures and different people have different sensitivities to toxic
molds, according to the lab report. The lab reports state that
different individuals have different sensitivities to molds and that
the only existing state standards for exposure levels, in New York and
California, are being challenged in court on that basis.

The airborne mold levels in all four units are below a New York
state mold exposure limits, according to the lab reports. The report
does not state whether the mold in the units meets the California
standard.

Lab reports for other County public housing units reported higher
airborne and surface spore counts than those found in unit 110, where
McConnell and Tattan live.

“The spore counts that came back are very, very low,” Pacheco
said.

But that’s misleading, McConnell suggested.

It’s not surprising that levels in unit 110 were low because
McConnell and Tattan went to extraordinary lengths to clean unit 110
of mold after they fell ill, McConnell said.

“We cleaned the entire house, stopped using the heater, taped over
the air vents,” McConnell said.

The Authority also provided McConnell and Tattan with an air
dehumidifier and space heaters in March, Pacheco confirmed.

The presence of airborne mold in unit 110 despite McConnell and
Tattan’s cleaning efforts and the presence of an air dehumidifier were
not reasons to suspect a toxic mold infestation, Pacheco said.

Pacheco did not ask Rhoades whether cleaning and the presence of
an air dehumidifier could cause an underestimation of the amount of
mold growing in the house, she said.

“We found species but the species were nontoxic,” Pacheco
initially said Monday. “We didn’t feel like we needed to ask (Rhoades)
anything.”

After reviewing the lab reports on Monday, she said that even if
they were potentially toxic species, they’re not toxic at the reported
levels.

“They’re molds but they’re not toxic at these levels,” Pacheco
said. “If Rhoades had said there was mold in there, we’d have removed
everyone and tested the entire complex.”

But Pacheco subsequently said only a doctor can determine whether
a given level of potentially toxic mold exposure is dangerous to a
particular person.

“I do believe these are nontoxic levels of mold,” Pacheco said.
“My understanding from Rhoades is it’s not a hazard to health.”

Ron Rhoades, who wrote the lab reports, could not be reached for
comment Tuesday.

The mold growths window sills in Ojo Caliente units 103 and 112,
dismissed as “mildew” by Pacheco, turned out to be dense growths of
toxic mold species, the lab report shows. The window sill growths in
unit 112 showed Aspergillus and Penicillium, as well as Alternaria,
another mold species of particular concern, according to the Agency
web site.

County housing unit 119 in Tierra Amarilla had Aspergillus and
Penicillium in the dining room, the lab reports show.

Pacheco found two other Ojo Caliente units with “mildew” when she
inspected all of the County’s public housing units in 2006, she said.
She did not remember which units those were.

When black stains have been encountered in units by Authority
staff, they’ve assumed it to be harmless mildew, Pacheco said.

“We’re just basing it on what we assume,” Pacheco said. “We assume
it’s mildew.”

Coriz said he had depended on Pacheco’s description of lab results
rather than the lab reports themselves.

The County plans to have all the units retested for mold but the
details have not been worked out, County Manager Lorenzo Valdez said.
The question is not whether the species found are potentially toxic
but whether the levels in the units are low enough to be safe, Coriz
said. He also expressed concern that by opening drywall to expose mold
behind the walls, McConnell may have placed himself and Tattan at
risk.

“By McConnell opening up the wall, it’s a whole different animal
now,” Coriz said. “When it was in the wall, it wasn’t exposed. Rhoades
did the test when the walls were closed up. He’ll have to go back and
do a new test. I hear they’re still in the apartment so I don’t know
to what extent they’ve exposed themselves to the mold now. It might be
toxic now. We want them out for their own safety.”

The couple had not been evicted as of Tuesday.
