Cuomo Sues Developer Trammell Crow for Failing to Provide Accessible Housing to People with Disabilities

DEVELOPERS MUST MAKE HOUSING ACCESSIBLE

Yesterday, Attorney General Andrew M. Cuomo announced agreements with six large real estate developers of rental apartment complexes to ensure equal access to housing for people with disabilities.

Under the agreements, the developers – Port Jefferson Town Properties, LLC; Fairfield Pinewoods, LLC; Hudson Park Investors, LLC and Collins Yonkers II, LLC; Regency Club at Wallkill, LLC; Riverbend at Wappingers Falls, LLC; and Main Street Lofts, LLC – must make or offer to make retrofits to apartments and common areas to ensure that people with disabilities have the full use and enjoyment of the facilities. The developers must also collectively pay $145,000 to compensate individuals who were harmed by the inaccessible housing. They will also work with an independent expert to certify that future construction of apartment complexes is in compliance with New York State and federal accessibility laws.

“Equal access to housing is a right guaranteed by law and no one should have problems living in their own home because they are disabled,” said Attorney General Cuomo. “My office is committed to enforcing fair housing and removing barriers for all New Yorkers.”

The Attorney General also filed a lawsuit against developer Trammell Crow for the company’s failure to remedy extensive inaccessible features in one of their complexes in New York State. Trammell Crow has developed more than 225,000 residential units across the country. The lawsuit alleges that Trammell Crow failed to design and construct Atlantic Point Apartments, a 795-unit complex in Bellport, New York, in compliance with the accessibility laws.

The Attorney General’s office found extensive design and construction barriers preventing full access by people with disabilities at the following apartment complexes:

•Atlantic Point Apartments, Bellport, New York
•Fairfield Knolls at Port Jefferson Station, Port Jefferson Station, New York
•Fairfield Knolls South, Coram, New York
•Hudson Park Apartments, Yonkers, New York
•Regency Club Apartments, Middletown, New York
•RiverBend Apartments, Wappingers Falls, New York
•66 Main Street Lofts, Yonkers, New York

Under the agreements, the six developers, who all cooperated with the Attorney General’s investigation, must complete retrofits for units and the common areas, including making sidewalks accessible by eliminating excess slopes and level changes. They must also provide accessible parking and routes to amenities such as pools, social rooms, mailboxes, and trash facilities. Furthermore, the agreements require retrofitting of bathrooms, kitchens, entryways, thermostats, and outlets in designated apartments.

Tenants living in the buildings will receive a notice advising them of the law and the structural changes to be made to the exterior and interior of their units. Tenants will be able to request additional modifications to increase accessibility. The modification will be free of charge to the tenants. Additionally, tenants who were harmed as a result the developers’ failure to construct the property as legally required will be eligible to receive restitution by submitting a claim to the Attorney General. The Attorney General will then evaluate the claims for compensation and disburse restitution from a $145,000 fund that will be paid by the developers.

The developers must also each hire a consultant, who must be approved by the Attorney General’s office, to conduct on-site inspections to determine whether retrofits have been completed as required by the agreement. The agreement also requires the developers to submit a certification to the Attorney General for all future construction confirming that they comply with the accessibility requirements under New York State and federal law.

Curtis Decker, Executive Director of the National Disability Rights Network, said, “We applaud Attorney General Cuomo for his commitment to the civil rights of all New Yorkers. These agreements ensure hundreds of accessible apartments for people with disabilities, and remind us that on the eve of the 20th anniversary of the Americans with Disabilities Act, we still have work to do.”

Joe Bravo, Executive Director of the Westchester Independent Living Center, said, “Individuals living with disabilities need accessible housing to live. Accessible housing is not a luxury, but rather a necessity. If you cannot get into your apartment or into your bathroom, how can you function? It is unacceptable that buildings are still being constructed that do not comply with the law. Attorney General Cuomo’s investigation and the agreements he has secured hold developers accountable and will require that they make retrofits to these buildings. This is a significant victory.”

Stephen McLaughlin, Executive Director of the Action Towards Independence, a not-for-profit organization that provides assistance to disabled individuals in New York, said, “Attorney General Cuomo has put housing developers on notice that inaccessible housing that violates the law will not be tolerated in New York. Building accessible housing rarely costs developers more money but is invaluable to disabled individuals and their families.”

These cases are being handled by Assistants Attorney General Brooke P. Davis, Sunita Kini-Tandon, and Vilda Vera Mayuga, under the supervision of Civil Rights Bureau Chief Alphonso B. David and Counsel for Civil Rights Spencer Freedman.

Emerging and reemerging infectious diseases are increasing worldwide and represent a major public health concern. One class of emerging human and animal diseases is caused by fungi. In this study, we examine the expansion on an outbreak of a fungus, Cryptococcus gattii, in the Pacific Northwest of the United States. This fungus has been considered a tropical fungus, but emerged to cause an outbreak in the temperate climes of Vancouver Island in 1999 that is now causing disease in humans and animals in the United States. In this study we applied a method of sequence bar-coding to determine how the isolates causing disease are related to those on Vancouver Island and elsewhere globally. We also expand on the discovery of a new pathogenic strain recently identified only in Oregon and show that it is highly virulent in immune cell and whole animal virulence experiments. These studies extend our understanding of how diseases emerge in new climates and how they adapt to these regions to cause disease. Our findings suggest further expansion into neighboring regions is likely to occur and aim to increase disease awareness in the region.

ScienceDaily (Apr. 22, 2010) — A newly discovered strain of an airborne fungus has caused several deaths in Oregon and seems poised to move into California and other adjacent areas, according to scientists at Duke University Medical Center.

“This novel fungus is worrisome because it appears to be a threat to otherwise healthy people,” said Edmond Byrnes III, a graduate student in the Duke Department of Molecular Genetics and Microbiology. “Typically, we see this fungal disease associated with transplant recipients and HIV-infected patients, but that is not what we are seeing.” Byrnes and other Duke co-authors work in the laboratory of senior author Joseph Heitman, M.D., Ph.D., and chair of the Department of Molecular Genetics and Microbiology.

Their new work on the emergence and virulence of the new genotypes of Cryptococcus gattii fungi in the United States was published online in PLoS Pathogens on April 22.

The mortality rate for recent C. gattii cases in the Pacific Northwest is running at approximately 25 percent out of 21 cases analyzed in the United States, compared to a mortality rate of 8.7 percent out of 218 cases in British Columbia, Canada, the researchers said. Most have a more complicated clinical course than people infected with the more common Cryptococcus neoformans.

Because the strain is so virulent when it infects some humans and animals, the researchers are calling for greater awareness and vigilance. Testing involves culturing the fungus and then sequencing its DNA to learn whether it is the virulent or more benign strain, which could affect treatment plans.

Some strains of C. gattii are not more virulent than C. neoformans, for example, but doctors need to know what type they are dealing with, Byrnes said. Using molecular techniques, the geneticists uncovered clues that showed the Oregon-only fungal type most likely arose recently, in addition to an outbreak of C. gattii that began in Canada in 1999 that has now spread into Washington and Oregon.

Symptoms can appear two to several months after exposure, and may include a cough lasting weeks, sharp chest pain, shortness of breath, headache (related to meningitis), fever, nighttime sweats and weight loss. In animals the symptoms are a runny nose, breathing problems, nervous system problems and raised bumps under the skin. While C. gattii can be treated, it cannot be prevented; there is no vaccine.

The new type of Cryptococcus gattii reproduces both sexually and asexually. The more virulent strain may have genetically recombined with related but less harmful strains. This novel genotype is highly virulent compared with similar isolates of Cryptococcus that are not causing disease outbreaks.

The researchers found that the novel genotype (VGIIc) is now a major source of Cryptococcus gattii illness in Oregon. Because C. gattii types had been found in tropical areas before, co-lead author Wenjun Li, M.D., Ph.D., of Duke Molecular Genetics and Microbiology, speculates that environmental changes may be responsible for the evolution and emergence of this pathogen.

Determining the exact origin of the VGIIc type is difficult, and sampling thus far has failed to turn up isolates in Oregon soil, water or trees.

“We are trying to put together the evolutionary story of where these types come from by closely studying the genetics of all samples possible,” said Yonathan Lewit, a research associate also in Duke Molecular Genetics and Microbiology. He said that cell components called mitochondria may play a role in the increased virulence of certain types.

VGIIc, the new Oregon strain, has yielded dozens of isolates in many specimens, including from domesticated animals: cats, dogs, an alpaca and a sheep. “Most of those are nonmigratory animals,” Byrnes said, explaining that the animals probably didn’t bring the pathogen from some other region, and most likely acquired it locally.

Riverstone Residential – Lexington Farms Apartments – Warning. Unhealthy. Dangerous. Conditions

Google Riverstone Residential Group Complaints, CAS Partners, and Blastomycosis NC. Riverstone Residential manages Lexington Farms Apartments, as well as over 200,000 other properties. Riverstone Residential is a third party managment group for CAS Partners: A huge corporation. Before you move-in google complaints. Those searches will inform you.

And just watch out. The bad economy has turned an already competitive market into something more aggresive. Something a huge third party managment corporation considers normal business practices.

The problems I encountered while living at Lexington Farms Apartments in Raleigh NC, are too numerous to detail in this review, but they include the following: Black mold and other mold types. Mice and mice droppings. A rat and rat droppings. A snake. Dirty and clogged AC. Leaking windows. Drainage problems. And some of the biggest spiders I have ever seen small ones too. Lots of them. However, the worst experience I had was the way management handled my complaints, and I how they treated me. For example, complaints about mold fell-on-deaf-ears. I was reated as if the mold didn’t exist or as if the problem was my fault. AND, when I moved out, they billed me for mold clean-up. I felt like I had been punched in the gut and spit on. Talk about adding insult to injury!

Lexington Farms Apartments is over 20-yrs-old. Black mold was inside all the cracks, dips, nooks, and crannies in the painted surfaces around the large floor-to-ceiling windows and kitchen herb window, so it is obvious the management knew about the mold. They encapsulate it, (just paint over), but it is still inside the walls.

I have since found out the way my mold complaints were handled is illegal. Moreover, prior mold infestations should have been disclosed. Lexington Farms simply repeatedly painted over the black mold that grows around the windows and window ledges. The drainage problems and leaky windows create a constant moist environment. Moreover, to get rid of mold odor, the complex hires a company to treat the offending apartments with very large and dangerous ozone generators. But, the musky earthy odors come back, but the lease has already been signed. While living at Lexington Farms, I took pictures because I felt the large amount of mold could be unhealthy. And because the complex did nothing about it. Little did I know I was developing respiratory problems. Google NC Blastomycosis.

I can’t give too many more details in this forum, but I have more, and this issue is ongoing. That being said, I’m sure Lexington Farms have some apartments that are mold free. I only lived in one, so’ However, I bet the whole building I lived in has problems.

Any health expert will throw the book at the word mold. Do some reasearch and realise websites like this and the other you look at are for people to complain. When was the last time you got happy and decided to blog about it how happy you were. Largest management equals more oppurtunity for complaints. I hate ignorant rviews and I love living here. let me give you some food for thought: How does mold get into a building? Molds are decomposers of organic material such as wood, plants and animals. Mold and mold spores are found in high concentrations wherever there is dead matter such as a pile of leaves, manure or compost. Mold spores enter buildings through the air or on people, animals and objects that are brought into the building. Spores are small bundles of genetic material and chemicals (similar to seeds) that molds make under certain conditions. Are there harmful and non-harmful molds? There are only a few molds that can cause infection in healthy humans. Some molds cause infections only in people with compromised immune systems. The biggest health problem from exposure to mold is allergy and asthma in susceptible people. There are more than 100,000 types of mold. Good information has been developed for only a small number of these molds ?? at least in terms of their effects on human health. Most people tolerate exposure to moderate levels of many different molds without any apparent adverse health effects. Some molds produce powerful chemicals called ??mycotoxins?? that can produce illness in animals and people. Scientific knowledge about the health effects of these toxins on humans is quite limited. Does mold affect everyone the same way? No. Some individuals have a genetic makeup that puts them at risk for developing allergies to mold. People who have an allergy to mold, especially if they also have asthma, can become ill from exposure to a small amount of mold. Individuals also seem to be quite different in their response to exposure to the toxic chemicals that some molds release. These differences between individuals contribute to the difficult question of determining safe exposure limits for mold. How much mold exposure is harmful? No one knows the answer to this question for several reasons. Individuals are very different with respect to the amount of mold exposure they can tolerate. Children under the age of one year may be more susceptible to the effects of some molds than older individuals. Measuring or estimating ??exposure?? levels is very difficult. ??Exposure?? means the amount of mold (microscopic spores and mold fragments) that gets into a person usually by breathing, but also by eating or absorption through the skin. For example, a building may have a lot of mold in the walls but very little of that mold is getting into the air stream. In that case the people working or living in that building would have little mold exposure. If mold is present, what??s the best way to get rid of it? The answer depends on how much mold is present and where it is located. If the mold is on furnishings or boxes simply discard the materials. Moldy materials are not considered hazardous waste; they can be sent to a regular landfill. However, it is smart to seal the mold material in heavy plastic to protect the people who handle it in transit and prevent spreading large amounts of the mold into the building as you carry the material out of it. If the mold is on a hard surface but occupies less than 10 square feet wash the area with soapy water (scrubbing with a brush may be necessary), rinse and allow the area to dry before repainting. If you have asthma, severe allergies and a weaken immune system get someone else to do the clean up. Larger areas (greater than 10 square feet in area) should be cleaned by someone with experience in doing this type of work. Remember, determine what caused the moisture problem and correct that problem. Otherwise, mold is likely to recur. The answer depends upon what is meant by ??completely eliminate mold.?? To keep a building completely free of mold spores requires very efficient air filtration and is only accomplished in special situations such as hospital operating rooms and manufacturing ??clean rooms.?? Remember, mold spores are in the outside air virtually all the time and some of them will get inside buildings. However, it is possible to keep mold from growing inside a building. Moisture control is the key to controlling mold in interior spaces. Air filtration can contribute to lowering mold spores in the air but is secondary to moisture control.

Hello Anonymous. Thank you for your comment in response to my experience and review of Lexington Farms Apartments. I appreciate the opportunity to expand the scope of my complaint. Clearly, there is regular-everyday-common-mold, inside and outside homes. And then there is MOLD. The grounds around my apartment chronically flooded. Those big windows are approximately a foot off the ground and the rain repeatedly splattered muddy material into and onto the window ledges. Water build up would form a small “pond” right outside my back windows. Furthermore, the apartment is positioned such that it never gets sunlight. The windows stay moist and leak. That moisture seeps inside the walls and around the window frames, which like I said are approximately a foot off the ground. I have detailed pictures: Macro images and others. And, btw, as a consumer for 50 years, I have in fact written many positive and glowing reviews. I believe in the free market, and word of mouth. It is the most effective form of advertisement available. Good or bad. Thanks also for your extensive information regarding mold. At this point, however, I have educated myself regarding multiple aspects of mold: Legal and health. And, I have seen what’s behind the walls. Like you stated in your comment, moisture control is the problem. Indeed, approximately 20 years of leaky windows, poor drainage, and no sunshine could in fact be the culprit. The AC also dripped water through the ceiling. Certainly all that water doesn’t do anything to hinder mold! I am glad you have a nice safe place. However, you should not judge others until you have walked in their shoes. Or, in this case, lived in their apartment. Peace.

Suit Aims to Make Banks Responsible for Condition of Foreclosed Buildings

“Tenants are entitled to housing that is safe and decently maintained. I applaud the many tenants of these buildings who organized themselves, the advocates who worked tirelessly on their behalf, and the lawyers from Legal Services NYC who are now bringing suit to ensure these tenants have decent and safe housing.”

A motion being filed today by LS-NYC Bronx, on behalf of tenants living in a portfolio of ten distressed apartment buildings, argues that once a foreclosure action is initiated, and a court-appointed receiver is in place, the mortgage holder can be held liable for maintaining building conditions.

The case concerns ten distressed apartment buildings housing more than 500 families. The portfolio has been in a steady state of decline since its owner, a private equity firm known as Milbank Real Estate, defaulted on its $35 million mortgage. In March of 2009, the mortgage holder, a $3 billion commercial mortgage-backed security trust controlled by Wells Fargo and serviced by LNR Partners, Inc., initiated foreclosure proceedings. The foreclosure judge appointed a receiver who is charged with collecting rents and managing the properties, but due to the high number of vacancies in the buildings, along with the already severely distressed conditions in most of the units, the income from rent collection is not adequate to properly maintain the portfolio.

The tenants have endured horrible living conditions, according to the suit, including water leaks, hazardous molds, cracked and peeling lead paint, collapsing ceilings, broken locks on entrance doors, useless intercoms, rat and roach infestations, busted boilers and electrical fires.

“These tenants deserve better — they pay their rent, work hard, and are suffering because of irresponsible lending practices by Wells Fargo, and irresponsible management by their previous landlord,” said Teresa Anderson, NWBCCC President. “Wells Fargo and other irresponsible banks and landlords will soon learn that when you mess with one tenant in the Bronx, you mess with all of us.”

LS-NYC Bronx attorneys hope that this legal strategy will force Wells Fargo and their agent, LNR Partners, Inc., to invest enough resources into the portfolio to bring conditions back up to acceptable levels.

“The Milbank tenants have suffered the consequences of Wall Street’s reckless lending practices for too long,” said Jonathan Levy, Deputy Director of the LS-NYC Bronx Housing Unit. “The lenders must be held accountable for the costs of repairing the damage.”

If the Milbank case is successful, it could impact the more than 4700 apartments in NYC in foreclosure.

“As properties like these move into foreclosure tenants are left in a state of limbo, not knowing who is responsible for critical repairs,” said City Council Speaker Christine C. Quinn. “Through this lawsuit, we’re saying that lenders must be held accountable for the properties they helped finance. No family should have to live in deplorable conditions because of the unsustainable investments that someone else made.”

“Yet again we are forced to tell a bank to pay attention to the needs of tenants when they sell a portfolio of apartments in the Bronx,” said Congressman Jose E. Serrano. “We had the same message during the Ocelot fight, and we were right then, as we are now. The tenants of Milbank Houses have a powerful new tool in a recent court decision that allows them to press the lender to ensure that the properties are adequately maintained. And this is the crux of the issue — we cannot have buildings falling apart as legal wrangling takes place over ownership or foreclosure. Tenants are entitled to housing that is safe and decently maintained. I applaud the many tenants of these buildings who organized themselves, the advocates who worked tirelessly on their behalf, and the lawyers from Legal Services NYC who are now bringing suit to ensure these tenants have decent and safe housing.”
