Louisiana Chemical Association expands attack on Tulane Environmental Law Clinic

A group representing big industry in Louisiana that contends actions by the Tulane Environmental Law Clinic drive jobs from the state has recommended to its members to stop all corporate donations to the university and cease recruiting its students.

The Louisiana Chemical Association sent a letter, obtained by The Associated Press, to its 63 corporate members last week detailing 12 “recommended sanctions” companies could employ against the university, encouraging them to stop recruiting Tulane students and to cease all corporate donations to the school.

LCA President Dan Borne said that the clinic, in suing companies and regulatory agencies, drives jobs from the state.

“The university flies cover for a unit that considers it an honor to attack state agencies and kills jobs,” Borne said Thursday in an e-mailed statement.

Tulane University President Scott Cowen called the group’s actions reprehensible.

“We’re the largest private employer in Orleans Parish and one of the largest in the state,” Cowen said. “To think that anyone would advocate damaging one of the largest employers in the state, that is an anti-economic development agenda if I’ve ever seen one.”

The lobbying group is also behind a Senate bill that would strip state funding from any university with law clinics that sue a government agency or business. The bill — scheduled for a May 19 hearing in the Senate Commerce Committee — is the “culmination of years of frustration with Tulane and its support for its environmental law clinic,” Borne wrote in the letter. Critics have said the bill would effectively shutter the majority of the state’s 19 law clinics.

Borne said the legislation was prompted by the environmental clinic’s push for the EPA to enforce ozone regulations in the greater Baton Rouge area. Borne holds that the area is already in compliance, so local industry should not be forced to shell out millions in penalty fees.

The bill represents just one prong of the LCA’s strategy to persuade Tulane to pull support for the clinic. Most of the proposed sanctions go after Tulane’s purse strings.

Cowen called the LCA’s strategy “unprecedented” and “embarrassing” for the association and its leadership.

Cowen emphasized that many of the LCA’s member companies, particularly the national and multinational ones, had been “terrific partners” of Tulane and that he doubted their CEOs would approve of the association’s plan.

Tulane has one of the best chemical engineering departments in the country, Cowen said, and many graduates already work for many of the chemical association’s members.

Borne said the LCA’s board voted on the actions against Tulane but that it was up to each company whether to apply any of the sanctions.

According to the letter, the chemical association also plans to complain about the clinic to Gov. Bobby Jindal.

In the late 1990s, the environmental clinic drew the ire of Gov. Mike Foster, who called the staff “a bunch of vigilantes out there to make their own law.” It came after the clinic sued successfully to stop construction of the Shintech plastic plant in a poor, predominantly black community in St. James Parish. That lawsuit led industry to complain about the clinic to the state supreme court, which limits clinics by allowing them to represent only the very indigent.

Stephen Griffin, interim dean of Tulane Law, said that in 2004, the chemical association launched a similar attack against the school that proved unsuccessful.

“Our donors are really pretty supportive regardless of what the LCA says,” he said.

Adam Babich, director of the Tulane Environmental Law Clinic, said the clinic’s 26 student lawyers represent clients and community groups concerned about polluters in their areas and also help ensure permits regulators issue comply with existing law.

Both the American Bar Association and the Louisiana State Bar Associations have weighed in against the bill, which would impact all of Louisiana’s law clinics.

“We urge the state legislature to consider that these law clinics represent the people of Louisiana who have very real and immediate problems but few resources to solve them,” ABA President Carolyn Lamm said in a statement.

Don’t believe anything you hear on these sites, especially if it’s a positive one. The management company requires each of their employees to write a positive review about the community in which they work. Their goal is to get each of their properties to at least an 80% rating on this site. Its sooo funny and ridiculous to hear the bull**** they are trying feed unsuspecting people who are already stressed enough with having to move, only to find they’ve moved into a HELL HOLE. The management company cares about nothing but $$$$, they don’t give a damn about their employees and ESPECIALLY not their residents. Riverstone Residential is sheisty, and even MORE shiesty is the owners of many of their properties… Ezralow Co. Pure GREED, that’s all I have to say about them, HORRIBLE people. I will show an honest rating of this property… Parking is ample, but by NO means is it safe, LOTS of car break-ins. Noise can be a problem on some days considering the area is a dump and it’s ghetto. Grounds are decent, lots of foilage and shade trees, but there are some spots that could use some work. Safety… lol, you wouldn’t believe the things that have gone down in that complex. Construction, they recently “remodeled”… with the CHEAPEST, LOWEST QUALITY MATERIALS THEY COULD FIND! Maintenance is pretty good, not much to say about them. Office Staff, LIARS, they are trained to make something so crappy sound like the best thing in the world for a measly $25 bonus. Overall, you will regret renting anything owned by Ezralow Co. As far as how many stars there are, i will rate it all at 1 star. This property does not deserve to have such a great rating, it’s all a lie.

Housing Terrorism: Public housing agencies retaliating against complaining tenants

To make a complaint at some of the nation’s public housing complexes often puts the tenant at risk of retaliation. Federal and state law prohibit retaliation by landlords and public housing agencies, but that hasn’t stopped many agencies of going after tenants who complain. There are subtle, fiendish and obvious ways of retaliation. 

Several residents of an elderly high rise in my hometown came to me with a problem.  Their apartment complexes were infested with bedbugs and management was ignoring them.  The director of the local housing authority allegedly told a tenant that it would be too costly to treat the apartments for the infestation. The situation had been going on for over a year.

Residents say the housing authority is run  like a Gestapo camp.  The employees have to sign a no-disclosure form and the board is reportedly intimidated as well. Residents say they believe they are being warehoused and treated like cattle, not people. And now, we’ve learned that complainers risk retaliation, in very nasty ways.

The bedbug infestation reportedly went on for more than a year, until one of the adult children of a resident went to the local health department.  Two others contacted a local reporter who worked for a black newspaper. After the story was published, other media jumped on it.  The local director said she was misquoted, but did begin ‘treating the apartments’ after the reporter began inquiries.

Residents of the elderly apartment towers say relations between management and tenants are hostile. What happened next will astound you.

One of the sources, whose activism makes her a thorn in the side of  administration, now says someone has entered her apartment and has planted bedbugs in retaliation.  Now, lest you shake your head, the coincidence is just too cute for this to be ‘happenstance.’

Less than 3 days after the story appeared, someone entered the apartment with a pass key.  The whistleblower knows this because her apartment is cluttered and she lives alone.  She paid no attention to the entry, believing that it was just a routine inspection.

Her mattress is an expensive sleep system and is less than a year old. Several days after the entry, she says she noticed bite marks on her arm. Now she has an arm full of bites and is wracking her brain about what to do.  The number of bedbugs and their sizes leads one to believe that they were planted, and she is at her wit’s end.

Diagnosed as clinically depressed, she struggles to form a plan of action.  When you are indigent, disabled and elderly, you are vulnerable.  Particularly if you have no relatives in town for support.

Around the nation, public housing residents who complain often face retaliation.   Take the case of a Texas double amputee, for instance.

A ParisTexasdisabled man living in public housing has expressed concerns for his safety following complaints to the local housing authority about mold in his apartment. Bobby Yates, a double-amputee living in George Wright Homes, now asserts that the Paris Housing Authority may be retaliating against him due to his retaining assistance from Lone Star Legal Aid about his living conditions. All across the country, fading revenues and the move to privatize public housing are pressuring  local housing authorities.  The competition for money, rising costs of operation, drug and alcohol abuse in the complexes are real challenges for administrators.

I’m fighting for my life – literally! My circumstances are very unusual, and I fall through the cracks of every government official and agency. Extremely high levels of toxic mold spores have been found in my townhome, and it’s been determined that it’s dangerous to live here. My doctor says I need to move ASAP. Problem is – I’m a disabled senior, who can’t afford to move. As it is, I’m trapped in a home that could kill me. Seems that my home insurance should pay to temporarily relocate me – at least until the problem is resolved, and the air is safe to breathe again. But they’re not willing to do so.
